Canada Issues WHMIS 2015 Implementing GHS in Workplace

Canada modified its Workplace Hazardous Materials Information System (WHMIS) to incorporate the Globally Harmonized System of Classification and Labelling of Chemicals (GHS) for workplace chemicals. 

Manufacturers or importers will be required to classify and label hazardous chemicals in accordance with the new GHS-based hazard communication system (called WHMIS 2015) from 1 June 2017. In this article, we have analyzed chemical classification, labelling and SDS requirements in WHIMS 2015 and compared it with OSHA's Hazard Communication Standards (HCS 2012) in the United States.

GHS Update Report 2015

2015 is destined to be a busy year for GHS - the Globally Harmonized System of Classification and Labelling of Chemicals. In this article we have summarized key GHS implementation dates in 2015 and what to expect next.

GHS Update 2015

Europe GHS 2015

    • Key date: 1 June 2015;
    • All mixtures have to be classified and labelled in accordance with EU CLP regulation/GHS since above date;
    • GHS for substance: already implemented;

USA GHS 2015

    • Key date: 1 June 2015;
    • All mixtures have to be classified and labelled in accordance with OSHA's Hazard Communication Standard 2012 since above date;
    • Distributors can sell hazardous mixtures with old labels until 1 Dec 2015;
    • GHS for substance: already implemented;

Turkey GHS 2015

    • Key dates: 1 June 2015 & 1 June 2016;
    • 1 June 2015: All substances have to be classified and labelled in accordance Turkish CLP regulation after this date;
    • 1 June 2016: GHS implementation deadline for mixture;

Malaysia GHS 2015

    • Key dates: 17 April 2015 & 1 Jan 2016;
    • 17 April 2015: GHS implemented for both substances and mixtures after this date;
    • 1 Jan 2016: Notification of inventory of hazardous chemicals supplied in the quantity of 1t/y or above starts.

Philippine GHS 2015

    • Key date: 14 March 2015;
    • GHS implementation deadline for both substances and mixtures in workplace;

Taiwan GHS 2015

    • Key dates: 26 Jan 2015 & 1 Jan 2016;
    • 26 Jan 2015: GHS Rev. 4 chemical classification criteria implemented;
    • 1 Jan 2016: Full GHS implementation for all hazardous chemicals with physical and health hazards.

GHS for Dummies

This is a post for beginners who wish to have a quick understanding of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS).

The Globally Harmonized System of Classification and Labelling of Chemicals (GHS) is a system developed by the United Nations for standardizing and harmonizing the classification and labelling of chemicals globally. More specifically, the UN GHS Document (known as the UN GHS Purple Book):

  • Defines physical, health and environmental hazards of chemicals and harmonizes classification criteria;
  • Standardizes the content and format of chemical labels and Safety Data Sheets.

The UN GHS is updated frequently and the latest version was the 5th revised edition released in 2013.

As a voluntary international system, the GHS is not legally binding in any country. Therefore, countries adopting GHS have to issue their own regulations or standards to implement GHS criteria and provisions. Two examples are:

Benefits of GHS Adoption

Compared to pre-GHS hazard communication, GHS offers better protection to workers and users and facilitates international chemical trade.

In pre-GHS era, users may see different label warnings or safety data sheet information for the same chemical, which can cause confusion. In addition to that, most of countries have their own hazard classification and labelling regulations in pre-GHS era. Those regulations vary significantly and compliance with them is very costly and time-consuming.

GHS Hazard Class, Hazard Category and Hazard Pictogram

GHS describes the nature and severity of a chemical hazard by hazard class and hazard category. GHS also assigns standard pictograms representing different types of hazards.
    • Hazard class: the nature of a chemical hazard, i.e., flammable liquids, carcinogen.
    • Hazard category: the division of criteria within each hazard class. For example, flammable liquids have 4 categories among which flammable liquids category 1 represents the most severe hazard.
    • Hazard pictogram: 9 pictograms conveying different types of health, physical and environmental hazards;

GHS Classification

GHS classification is a process to determine the hazard class and category of a chemical (substance or mixture) in accordance with GHS hazard classification criteria.

The picture below is an example of GHS classification criteria for flammable liquids. A liquid with a flash point between 23 and 60 Celsius degrees will be classified as flammable liquid category 3. A liquid with a flash point above 93 Celsius degrees does not meet GHS classification criteria and will not be regarded as a hazardous chemical.

Classification Determines Labelling Elements

Once a chemical has been classified according to GHS classification criteria, you can easily find assigned signal word, pictogram, hazard statements and precautionary statements that need to be included on labels and in SDSs. 
For example, a liquid with a flash point between 23 and 60 Celsius degrees will be classified as flammable liquid category 3. By checking the page 316 of above document, you can easily find out the core labelling elements for this liquid:
    • Signal word: Warning;
    • Pictogram: Flame;
    • Hazard statement: H226 flammable liquid and vapour;
    • Precautionary statement: P210, P233, P280, P303+P361+P353, P370+P378, P403+P235, P501;

How to Classify Substances and Mixtures under GHS

Classification is very important but not easy. For substances, you need to have test data to carry out classification. Luckily you do not need to test every substance. Many countries or regions have published compulsory or advisory GHS classification lists for pure substances. You can directly refer to those classifications for your substances without doing the tests.
The most well-known GHS classification list is the annex VI of EU CLP regulation. It includes compulsory GHS classifications for thousands of substances.

For mixtures, you may take advantages of abridging principles or calculation methods or concentration limits to classify them.

GHS Label

The core elements of a GHS label include:
    • Product identifier: Chemical identities of a substance or hazardous ingredients in a mixture;
    • Supplier identification: The name, address and telephone number of a supplier;
    • Signal word: Danger or Warning;
    • Hazard pictogram: conveying different types of chemical hazards;
    • Hazard statements: standardized and assigned phrases that describe the hazard(s) as determined by hazard classification;
    • Precautionary statements: standardized phrases that describe measures to minimize or prevent adverse effects;

GHS in Australia

Australia will implement GHS for workplace hazardous chemicals (both substances and mixtures) from 1 Jan 2017. Right now, GHS SDSs and labels are not compulsory in Australia. The model Work Health and Safety Regulations (WHS Regulations) issued in 2011 impose a duty on manufacturers and importers of chemicals supplied to a workplace to correctly classify the chemical according to GHS Rev. 3, label hazardous chemicals in workplace and provide safety data sheets.


Classification and Building Blocks

There is no separate guidance on chemical classification in Australia. The new WHS Regulations directly reference UN GHS Rev. 3. The following building blocks are not adopted.
    • acute toxicity - Category 5;
    • serious eye damage/eye irritation - Category 2B;
    • aspiration hazard - Category 2;
    • flammable gas - Category 2;
    • acute hazard to the aquatic environment - Category 1, 2 or 3;
    • chronic hazard to the aquatic environment - Categories 1, 2, 3 or 4, or
    • hazardous to the ozone layer.

Safe Work Australia has published a list of chemicals classified in accordance with GHS. The classifications are non-mandatory under the WHS Regulations, and should be used as guidance only.


Labelling of Workplace Hazardous Chemicals

Australia has adopted standard GHS label elements for workplace hazardous chemicals. The picture below is an example of Australian GHS label given by Safe Work Australia.

Like many other countries, Australia also has its own unique labelling requirements. Such requirements are set by the Code of Practice for Labelling of Workplace Hazardous Chemicals.
    • Must include Australian contact details of the manufacturer or importer;
    • Max. number of p-statements: 6~10;
    • Additional info required if available: the expiry date of the chemical (if applicable), overseas supplier's contact info, emergency contact number, website address and reference to SDSs;
    • Size requirement: see picture below;
    • Small containers (size not defined):
      • Minimum info required: product identifier, Australian contact info, and hazard pictogram or hazard statements;
      • Must include as much labelling information as possible, particularly significant hazards;
      • "Refer to the Safety Data Sheet" is recommended;

Safety Data Sheets (SDS)

The format and content of Safety Data Sheets (SDS) are set by the Code of Practice for the Preparation of Safety Data Sheets for Hazardous Chemicals. A SDS prepared in accordance with GHS regulations in other countries (for example, the EU CLP Regulation must be checked for compliance with the WHS Regulations and amended if necessary to bring it into compliance.
    • Standard 16-section SDSs;
    • Emergency phone number: Must include Australian emergency contact information which is available outside of working hours;
    • Pictogram size: >1cm x1 cm and <2cm x2 cm;
    • Section 15: Indication of whether a hazardous chemical is subject to the control of International conventions and domestic regulations such as NICNAS.

Information Disclosure on Labels and in SDSs

    • General Principle: The chemical identity of a hazardous ingredient contributing to the classification of a chemical or a substance with occupational exposure limits must be disclosed;
    • Chemical Identity Disclosure: Use of generic name for a hazardous ingredient only accepted in certain cases (moderate hazard category and no occupational exposure limit established);
    • Concentration Disclosure: Percentages should be listed in descending order by mass or volume; If the exact concentration of an ingredient is confidential, the concentration of the ingredient can be disclosed using the following range or narrower range: <10%, 10-30%, 30%-60%, >60%;

GHS in the Philippines

Philippines has already implemented GHS in workplace through the "Guidelines for the Implementation of Global Harmonised System (GHS) in Chemical Safety Program in the Workplace" issued in 2014. GHS SDSs and labels are required for hazardous substances and mixtures in workplace from 14 March 2015. The table below summarizes the latest status of GHS in the Philippines and the main requirements on SDSs and labels for hazardous chemicals.

GHS Implementation in the United States

The United States has implemented GHS in workplace through revised Hazard Communication Standard (HCS) issued by the Occupational Safety and Health Administration (OSHA) in 2012. All hazardous substances and mixtures need to be classified and labelled in accordance with the new HCS from 1 June 2015.

Classification & Building Blocks - HCS
  • Based on GHS Rev. 3;
  • Acute Toxicity 5 not adopted;
  • Extra classification criteria for OSHA defined hazards - Hazards Not Otherwise Classified (HNOC): pyrophoric gases, simple asphyxiants, and combustible dust;
  • International Agency for Research on Cancer (IARC) and the National Toxicology Program (NTP) classifications are mandatory in SDSs;

New Zealand and GHS

New Zealand is one of the earliest countries that have adopted GHS. New Zealand had adopted a GHS based hazard classification framework in 2001 and had been working on an implementation program since that time. Since July 2006, all hazardous substances had been covered by this GHS-based legislative framework. The table below summarizes the latest status of GHS in New Zealand and the main requirements on SDSs and labels for hazardous chemicals.

Vietnam has already implemented GHS through the Chemical Law, Decree 108/2008/ND-CP and Circular no. 04/2012/TT-BCT. GHS SDSs and labels are required for hazardous substances from 30 March 2014. Turkish CLP Regulation - Regulation on Classification, labelling and Packaging (CLP) of Dangerous Substances and Preparations

The Turkish Ministry of Environment and Urbanization has issued revised Regulation on Classification, labelling and Packaging (CLP) of Dangerous Substances and Preparations in their Official Gazette with number 28848 on 11 December 2013. This regulation, also known as SEA regulation in Turkish, is aligned with EU CLP Regulation (1272/2008 EC) and fully enters into force on 1 June 2016.

The regulation sets detailed rules and principles for chemical classification, labelling and packaging in Turkey and brings GHS concepts to Turkey. Similar EU CLP regulation, it also requires manufacturers and importers to notify the classification and labeling of hazardous substances and mixtures to Turkish C&L Inventory ("C&L Notification").

Turkish SDS Regulation - Regulation on Preparation and Distribution of Safety Data Sheets

The latest Turkish SDS Regulation - Regulation on Preparation and Distribution of Safety Data Sheets regarding Dangerous Substances and Preparations is published in Official Gazette with number 29204 on 15 Dec 2014 and fully comes into force on 1 June 2016.

It aligns the Turkish SDS format with EU SDS regulation 453/2010/EC and sets detailed requirements on the content and order of sections in Turkish SDSs.

Key Requirements of Turkish SDS Regulation

    • Standard 16-section SDSs;
    • Must be prepared in Turkish and provided free of charge;
    • Must be prepared by certified SDS experts in Turkey;
    • A copy of SDSs shall be submitted to the Ministry of Environment and Urbanization.

Please note an expert holding a current certificate cannot prepare new SDSs before he/she receives new accreditations.

Malaysia's Industry Code of Practice on Chemicals Classification and Hazard Communication (ICoP)

GHS has been introduced to Malaysia via CLASS Regulations issued in Oct 2013 and the Industry Code of Practice on Chemicals Classification and Hazard Communication(ICOP) issued on 16 April 2014. Industry has been given one year grace period to comply with CLASS Regulations and ICOP since ICOP was published.

ICOP is promulgated as a guidance to help the industry comply with CLASS Regulations. It sets out detailed requirements on chemical classifications, labelling and safety data sheets (SDS).

ICOP consists of four parts:
    • Part I: List of Classified Chemicals
    • Part II: Chemicals Classification
    • Part III: Hazard Communication: Labelling and Safety Data Sheet
    • Part IV: Confidential Business Information

Classification & Building Blocks in ICOP

The Part I of ICOP contains a list of chemical substances that have been classified by DOSH. For hazardous substances on the list, companies must use the classifications given on the list.

For substances not on the list, companies shall use classification criteria given in Part II to classify their chemicals. The classification criteria are aligned with UN GHS Rev. 3. The following building blocks are not adopted by Malaysisa.
    • Flammable Liquids Cate. 4;
    • Acute Toxicity Cate. 5;
    • Skin corrosion/irritation Cate. 3;
    • Aspiration Cate. 2;
    • Acute Aquatic Hazards Cate. 2 & 3;

Labelling

    • Minimum font size: 7 points;
    • Pictogram size: one fifteenth of the surface area of a label(minimum 10 mm x 10 mm);
    • Small package (<=125 ml): hazard and precautionary statements can be omitted; plus a statement "read SDSs before use".
    • Language: in both national language and English;
    • Label size: depending on package volume(please refer to the table below).

GB 15258-2009 General rules for preparation of precautionary label for chemicals

GB 15258-2009 General rules for preparation of precautionary label for chemicals has set detailed requirements on the content and format of chemical labels. China has adopted standard GHS label elements(see example given below) and set additional requirements on language, 24h emergency telephone number, and sizes, etc. This standard is compulsory.

Detailed Requirements of GB 15258-2009

    • Language: simplified Chinese;
    • Chemical identification: in both Chinese and English;
    • Display of hazard statements: physical hazards must be displayed first followed by health hazards and environmental hazards;
    • Domestic 24h emergency telephone number: required for imported hazardous chemicals;
    • Small packages (<=100ml): precautionary statements can be omitted;
    • Border color of a pictogram: black only allowed for chemicals for domestic use;
    • Pictogram size: not specified; must be visible from a distance;
    • Label size: depending on package capacity( please refer to the table below);

China GHS Label Size Requirement

For workplace labelling, companies shall refer to GB 30000.30-201x (draft version available). For labelling of consumer products, companies shall refer to a separate standard called "risk-based GHS labelling of consumer product" which is also being drafted by SAC.

GB 30000.2-29-2013 Safety rules for classification and labelling of chemicals

In 2013, the Standardization Administration of the People's Republic of China (SAC) issued 28 compulsory chemical classification standards (GB 30000.2-2013 to GB 30000.29-2013 Safety rules for classification and labelling of chemicals) and each standard corresponds to one hazard class under GHS. The standards come into force on 1 Nov 2014.

Those classification standards are fully aligned with UN GHS Rev. 4 and have adopted all building blocks under UN GHS Rev. 4 including aspiration hazards and hazards to the ozone layer. For those who are interested in knowing chemical classification criteria in China, they may directly refer to the English version of UN GHS Rev. 4 since GB 30000.2~29 are directly translated from UN GHS Rev. 4.

Taiwan Regulation of Labelling and Hazard Communication of Hazardous Chemicals

The  Regulation of Labelling and Hazard Communication of Hazardous Chemicals is the most important regulation for implementing GHS in Taiwan. It was amended in 2014 by MoL and comes into force on 3 July 2014. The revised regulation requires manufacturers, importers or suppliers to provide labelling and SDSs for all hazardous chemicals with physical and health hazards from 1 Jan 2016.
GHS in workplace is implemented in 4 phases in Taiwan. MoL(previously the Council of Labor) has published 3 lists of hazardous chemicals subject to mandatory GHS compliance.
    • First Phase: 1062 chemicals;
    • Second Phase: 1089 chemicals;
    • Third Phase: 1020 chemicals;
    • Last Phase: All hazardous chemicals with physical and health hazards(from 1 Jan 2016).

GB/T 17519-2013 Guidance on the compilation of safety data sheet for chemical products

In China, the most important standards specifying the content and format of SDSs in China are GB/T 16483-2008 safety data sheet for chemical products: content and order of sections issued in 2008 and GB/T 17519-2013 Guidance on the compilation of safety data sheet for chemical products issued in 2013. GB/T 16483-2008 specifies the basic content and order of 16 sections in Chinese SDSs while GB/T 17519-2013 provides detailed guidelines on how each section should be compiled in China.
    • Product identification: Consistent with names on label;
    • Composition information: Hazardous ingredients displayed in a descending order based on concentration or concentration ranges;
    • 24h emergency telephone number: Required;
    • Language: Must be prepared in simplified Chinese.

Information Disclosure in SDSs

Both GB 15258-2009 and GB/T 17519-2013 have given clear guidance on information disclosure on labels and in SDSs. Hazardous ingredients contributing to the classification of a substance or mixture and their concentration or concentration ranges shall be disclosed. Generic names are acceptable.

Catalogue of Hazardous Chemicals in China

The Catalogue of Hazardous Chemicals is promulgated by 10 ministries in accordance with Decree 591 Regulations on Safe Management of Hazardous Chemicals. It is an administrative license Catalogue which means that businesses that produce, import, distribute or use hazardous chemicals in the Catalogue are subject to license requirements (production license, operation license, safe use license, etc.)
The current Catalogue of Hazardous Chemicals was issued in 2002 and contains more than 3,800 chemicals. A revised draft version was issued in 2013 and includes nearly 3,000 kinds of chemicals. Please note that the Catalogue includes both substances and mixtures. Some entries are generic entries matching a group of substances with similar hazard properties.
Catalogue of Hazardous Chemicals and Compulsory GHS Classifications in China 
For many chemicals listed in the Catalogue, the State Administration of Work Safety (SAWS) will publish their GHS classifications in a separate guidance document. Companies must use the classifications given in the guidance or more severe classifications to classify their chemicals and prepare SDSs and labels.

Japan PRTR Law

The law concerning reporting, etc. of the release to the environment of specific chemical substances and promoting improvement in their management ("Law for PRTR and Promotion of Chemical Management" or "Japan PRTR Law") was enacted in 1999. The purpose of this law is to promote businesses' voluntary improvements in the management of specified chemical substances and to prevent any environmental protection impediments. This law requires businesses to report the release and transfer of chemical substances of concern(PRTR reporting) under the PRTR System and to provide information on them under the SDS System.

Under PRTR law, Class I Designated Chemical Substances are subject to both the PRTR system and the SDS system while Class II Designated Chemical Substances are subject to SDS system only. Only businesses in the published types of industries are obliged to confirm and notify the release amounts of chemical substances in the environment.

JIS7253 Hazard Communication of Chemicals Based on GHS - Labelling and Safety Data Sheet

The most important hazard communication and SDS/labelling standard in Japan is JIS7253 Hazard Communication of Chemicals Based on GHS - Labelling and Safety Data Sheet. This standard sets detailed SDS/labelling/info disclsoure requirements in Japan. It was updated in 2013 and will replace previous standard from 1 Jan 2017.

In addition to standard GHS label elements, JIS7253 require companies to label additional info required by other domestic regulations. For example, "danger division" under Fire Service Law and "Poisonous substance" or "deleterious substance" under Poisonous and Deleterious Substances Control Law also need to be labelled if applicable.

The most important and updated GHS classification standard in Japan is Japan JIS 7252-2014 Classification of Chemicals Based on GHS. That latest version is based on GHS rev. 4 and issued in 2014. The following GHS building blocks have not been adopted in Japan:
    • acute toxicity category 5;
    • skin irritation category 3;
    • aspiration toxicity category 2;

The Ministry of Health, Labour and Welfare (MHLW) and Ministry of the Environment (MOE) have conducted GHS classifications on hundreds of substances to help companies prepare SDSs and labels. The classifications can be downloaded via the link below and they are not legally binding.
