Turkish REACH-like Regulation - Regulation on the Inventory and Control of Chemicals (CICR)

The Regulation on the Inventory and Control of Chemicals, known as "Turkish REACH-like regulation", entered into force on 26 December 2008 in Turkey. The main purpose of this regulation is to form a national chemical inventory in Turkey and gather hazard info on high volume substances placed on Turkish market.

This regulation requires that manufacturers and importers notify certain information to the chemical inventory of the Ministry of Environment and Urbanization (MoEU) on all existing and new substances, either on their own or in preparation(s), imported or manufactured in Turkey in quantities above 1 tonne per year. The deadline for notification is 31 March 2011.

It shall be noted that Turkey is drafting a new chemical regulation called "KKDIK regulation" which require companies to register all substances manufactured or imported with volume above 1t/y before a given deadline. This regulation is more similar to EU REACH regulation and may be called real "Turkey REACH" when it is published. More info about KKDIK regulation can be found here.

Data Requirements of CICR

Data requirements for inventory notification under CICR depend on the tonnage per annum manufactured or imported into Turkey:

• 1-1000 tonnes per year: only basic information such as chemical identity, uses and classification and labelling;
• 1000 tonnes per year or above: substantial information required including physicochemical, toxicological, and eco-toxicological characteristics of substances;

Late Inventory Notification

Manufacturers or importers who have manufactured or imported substances on their own or in a preparation for the first time, in quantities of more than 1 ton per year after 1 Jan 2010, shall submit the information to MEoU within three months after one year from the date on which the substance was produced or imported for the first time.

Exemptions from Inventory Notification

• Substances in transit;
• Substances for national defense purpose;
• Substances <1 ton per annum;
• Naturally occurring substances;
• Substances on the published list of substances for which hazard properties are well-known(i.e, noble gases, glucose, etc);
• Polymers.

Turkish CLP Regulation - Regulation on Classification, labelling and Packaging (CLP) of Dangerous Substances and Preparations

The Turkish Ministry of Environment and Urbanization has issued revised Regulation on Classification, labelling and Packaging (CLP) of Dangerous Substances and Preparations in their Official Gazette with number 28848 on 11 December 2013. This regulation, also known as SEA regulation in Turkish, is aligned with EU CLP Regulation (1272/2008 EC) and fully enters into force on 1 June 2016.

The regulation sets detailed rules and principles for chemical classification, labelling and packaging in Turkey and brings GHS concepts to Turkey. Similar EU CLP regulation, it also requires manufacturers and importers to notify the classification and labeling of hazardous substances and mixtures to Turkish C&L Inventory ("C&L Notification").

Turkish SDS Regulation - Regulation on Preparation and Distribution of Safety Data Sheets

The latest Turkish SDS Regulation - Regulation on Preparation and Distribution of Safety Data Sheets regarding Dangerous Substances and Preparations is published in Official Gazette with number 29204 on 15 Dec 2014 and fully comes into force on 1 June 2016.

It aligns the Turkish SDS format with EU SDS regulation 453/2010/EC and sets detailed requirements on the content and order of sections in Turkish SDSs.

Key Requirements of Turkish SDS Regulation

• Standard 16-section SDSs;
• Must be prepared in Turkish and provided free of charge;
• Must be prepared by certified SDS experts in Turkey;
• A copy of SDSs shall be submitted to the Ministry of Environment and Urbanization.

Please note an expert holding a current certificate cannot prepare new SDSs before he/she receives new accreditations.

Critical Dates of Turkish SDS Regulation

15 Dec 2014	The regulation comes into force;
1 June 2015	Mandatory for hazardous substances;
1 June 2016	Mandatory for both hazardous substances and mixtures.

Turkey REACH - KKDIK Regulation

KKDIK regulation is a new chemical regulation being drafted by the Ministry of Environment and Urbanization(MoEU) in Turkey. "KKDIK" are the first letters of REACH written in Turkish. This regulation requires companies to register all substances manufactured in Turkey or imported into Turkey with volume above 1t/y before a given deadline (Proposed deadline: 31 Dec 2018). This regulation is more similar to EU REACH regulation and may be called real "Turkey REACH" when it is published.

Currently the Regulation on the Inventory and Control of Chemicals (CICR) is also called "Turkey REACH". More info about CICR can be found here.

Latest Status of KKDIK Regulation in Turkey

The draft KKDIK regulation is published for public consultations in Aug 2014. The deadline for comments is 31 Oct 2014. The summary of the draft KKDIK regulation is listed as follows:

• Registrant: Manufacturer/importer/only representative appointed by companies outside of Turkey;
• Registration Target: All substances >=1t/y;
• Registration Period: 31 Dec 2015 to 31 Dec 2018;
• Registration Deadline: 31 Dec 2018;
• Risk Assessment: Needs to be done by a certified risk assessor.
